These Terms and Conditions govern the use of the Masquerade Costume Hire and Sales website, online store, and costume hire services.
By accessing this website, purchasing products, or hiring costumes from Masquerade Costume Hire and Sales (“Masquerade”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions.
These Terms are governed by the laws of the Republic of South Africa.
WEBSITE USE
- Use of Website
You agree to use this website only for lawful purposes and not for any activity that may damage, disrupt, or interfere with the website or its services.
Masquerade reserves the right to suspend or terminate access to the website if these terms are violated.
- Product Information
We make every effort to display products and colours accurately. However, actual products may vary slightly from images shown on the website.
All products are subject to availability and Masquerade reserves the right to:
- limit quantities available for purchase
- discontinue products without notice
- adjust pricing without prior notice
PAYMENTS
- Cashless Payment Policy
For the safety and security of our staff and customers, Masquerade Costume Hire and Sales operates as a cashless business.
We do not accept cash payments.
Payments may be made using:
- debit cards
- credit cards
- electronic bank transfer (EFT)
- approved online payment gateways
- Orders
Orders placed through our website are only confirmed once payment has been successfully processed.
Masquerade reserves the right to cancel or refuse any order suspected of fraud, incorrect pricing, or stock unavailability.
SHIPPING AND DELIVERY
- Delivery
Delivery times may vary depending on courier services and location.
Masquerade is not responsible for delays caused by courier services, public holidays, weather conditions, or circumstances beyond our control.
Risk in the goods passes to the customer once the order has been delivered.
COSTUME HIRE
- Ownership of Costumes
All hired costumes, accessories and related items remain the property of Masquerade Costume Hire and Sales at all times.
- Hire Period
Costumes are hired for the agreed hire period.
All hired items must be returned on or before the agreed return date.
- Security Deposits
A refundable security deposit may be required when hiring costumes.
Deposits are held as security against damage, loss, theft, missing accessories, or late return.
Deposits may be used toward repair, cleaning or replacement costs where applicable.
- Late Returns
Items returned after the agreed return date may incur additional daily hire charges until the item is returned.
Failure to return hired items may result in the full replacement value being charged.
- Damage, Loss or Theft
Customers are responsible for the care of hired items while in their possession.
If a hired item is lost, stolen or damaged beyond normal wear, the customer agrees to pay the repair cost or full replacement value.
If the cost exceeds the deposit amount, the customer remains responsible for the outstanding balance.
- Cleaning and Condition
Items must be returned in the same condition in which they were hired.
Additional cleaning charges may apply if items are returned with excessive dirt, stains, smoke smell, perfume odours, makeup marks, or other avoidable damage.
- Accessories
Accessories supplied with costumes, including but not limited to hats, belts, capes, props, jewellery or gloves, form part of the hire and must be returned together with the costume.
Missing accessories may result in replacement charges.
- Restricted Use
Costumes must not be used with substances that may permanently damage fabrics including:
- glitter
- body paint
- coloured powder
- fake blood
- spray paint
- strong adhesives
Damage caused by such substances may result in the full replacement value being charged.
- Hire Fees and Refunds
All costume hire fees are strictly non-refundable.
Once hired items leave the store premises, the hire fee becomes immediately due and payable and no refunds or credits will be issued for any reason, including change of mind, event cancellation, incorrect sizing, or non-use of the hired items.
- Exchanges
Exchanges for hired items may only be considered within 24 hours of collection and only if the items have not been worn, altered, or damaged.
Masquerade reserves the right to refuse exchanges if items show signs of wear including makeup marks, perfume or smoke odours, stretching, or removed tags.
SALES ITEMS
- Returns and Exchanges
Masquerade does not offer refunds for change of mind on sales items.
Exchanges or store credit may be offered within 7 days of purchase, provided that:
- items are unused
- original tags remain attached
- items are returned in original packaging
- proof of purchase is provided
This policy does not affect your rights under the Consumer Protection Act.
- Defective Products
If a product is defective, customers may return the item within 6 months of purchase in accordance with the Consumer Protection Act.
Masquerade reserves the right to inspect returned items before approving a repair, replacement, or refund.
Items that have been worn, altered, damaged, or improperly handled will not be considered defective.
- Non-Returnable Items
Due to hygiene and safety regulations, certain items cannot be returned or exchanged once opened or worn. These include but are not limited to:
- wigs
- hats and headwear
- bodysuits or leotards
- pantyhose or hosiery
- contact lenses
- makeup or cosmetic products
- face gems or adhesive cosmetic items
These items may only be returned if they are defective at the time of purchase.
LIABILITY
- Limitation of Liability
Costumes and accessories are worn and used at the customer’s own risk.
Masquerade Costume Hire and Sales shall not be liable for any injuries, damages, or losses arising from the use or misuse of costumes or accessories.
INTELLECTUAL PROPERTY
- Intellectual Property
All content on this website including logos, images, graphics, text and branding remains the property of Masquerade Costume Hire and Sales.
No content may be reproduced or used without written permission.
GOVERNING LAW
- Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
